General and Booking Terms and Conditions for Holiday Home "Joie de Vivre" - 28May2026.
Definitions
Landlord: RRJ Herfkens, based in Dreischor.
Accommodation: the holiday home as offered on the website.
Renter: the person who makes the booking and is responsible for all fellow guests.
Stay: the agreed rental period.
2. Formation of the booking
A booking is finalized once the landlord has confirmed the reservation in writing or by email.
The tenant receives a booking confirmation with the rental price, additional costs, and payment terms.
The tenant must be at least 18 years old.
3. Payment
Upon booking, a first payment of 40% of the total rental amount is due and payable immediately (within 48 hours) after the reservation has been confirmed in writing.
The final payment of 60% by the tenant must be made at least 6 weeks prior to the start of the rental period.
For bookings made within 6 weeks of the rental period, the full amount must be paid immediately (within 48 hours).
If payment(s) are not received, the landlord has the right to cancel the booking immediately. Any amounts already paid will not be refunded to the potential tenant.
4. Mortgage
The tenant pays a deposit of €500. The deposit is deducted from the rent.
The deposit will be refunded within 7 days after departure, provided that no damage, missing items or additional cleaning costs have been identified.
Any damage will be deducted from the security deposit.
5. Arrival and departure
Check-in from 5:00 PM.
Check out by 9:30 AM at the latest.
Deviating times are only possible after prior consultation.
In extreme heat
During periods of extreme heat, additional measures may be necessary in France to protect people working outdoors or in hot spaces.
When an official heat warning is in effect for the Dordogne (from code yellow issued by Météo France) and it is necessary for the cleaning staff to start earlier, the check-out time can be brought forward from 09:30 to 08:30 at the latest. This allows them to safely prepare the house for the next guests before the hottest hours of the day. Our garden and pool maintenance staff will also start earlier than the check-out time if necessary to carry out their work safely.
Our staff follows all regulations and any tightening measures from the local authorities. Not only in extreme heat but also when their safety and/or health may be at risk for other reasons.
6. Use of the accommodation
The accommodation may only be used by the number of persons stated in the booking.
Festivals, events and commercial activities are not permitted without written consent.
The tenant is expected to behave as a good father of the house and to take into account the surroundings.
Smoking is not allowed.
1 One dog is allowed, multiple dogs only after written permission from the landlord.
7. Damage and liability
The tenant is liable for damage caused by himself, fellow guests or visitors.
The landlord is not liable for loss, theft or damage to the tenant's property.
The use of the accommodation and any facilities is at your own risk. In addition, some safety rules have been drawn up for the use of the swimming pool.
8. Complaints
Complaints and/or damage must be reported immediately upon arrival and/or during the stay (in writing and with photos in case of damage) so that an appropriate solution can be found. Via email [email protected].
9. Force Majeure
Force majeure refers to any situation beyond the reasonable control of the landlord, including natural disasters, government and/or regional measures, power outages, pandemics, and other unforeseen circumstances. In such cases, the landlord cannot be held liable.
10. Privacy
Personal data is used exclusively for the processing of reservations and communication related to the stay, in accordance with the applicable privacy legislation in France and the Netherlands. See privacy conditions.
11. Applicable law and disputes
This agreement is governed by French law.
Disputes arising from this agreement shall be submitted to the competent court of the district where the accommodation is located, unless mandatory consumer rules provide otherwise.
If a provision of these terms and conditions proves to be invalid, the remaining provisions will remain in full force and effect.
12. Tourist tax (Taxe de Séjour)
The tenant is liable for tourist tax in accordance with the applicable regulations of the municipality where the accommodation is located.
The tourist tax is included in the rental price.
Changes in local tax rates may be passed on to the tenant.
13. Mandatory guest registration
The tenant is responsible for providing correct data of all guests for compliance with French legal obligations or local regulations.
15. Swimming pool and outdoor facilities (if applicable)
The swimming pool is open from May 1st until the end of September and is heated in the pre- and post-season to approximately 26 degrees C.
The use of the swimming pool, playground equipment, and other facilities is entirely at your own risk.
Parents of supervisors are always responsible for supervising minor guests.
The tenant must strictly adhere to the safety regulations present in or near the accommodation. Also see the attached pool safety rules as stated in the "house rules".
